By accessing or using Startly.run ("Startly," "the Service," "we," "us," or "our"), including our mobile applications, web application, and website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Startly is a race-day preparation application for runners. The Service provides:
- Race tracking with countdowns and checklists
- Auto-generated and customizable checklists
- Weather forecasts for race locations
- Pace calculator and PR tracking
- Race-Day Mode (calm, distraction-free race morning experience)
- Race photo storage and shareable race cards (Pro)
3. Account Registration
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account.
- You must be at least 13 years of age to use the Service.
- You may not create an account on behalf of someone else without their permission.
- You agree to provide accurate information and keep it up to date.
4. Free and Pro Plans
Free Plan
The Free plan includes core features at no cost, with certain limits (e.g., up to 2 upcoming races per year, 1 free Race-Day Mode use). Free plan features may change over time, but we will not remove core functionality without notice.
Pro Plan
- Pro is a paid subscription at $24.99/year (or as otherwise displayed at time of purchase).
- Subscriptions are managed through the Apple App Store or Google Play Store.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your App Store or Google Play account settings.
- Refunds are handled by Apple or Google according to their respective policies. You may also contact us within 30 days of purchase for a refund.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Upload malicious content, viruses, or harmful code
- Use automated tools to scrape, crawl, or extract data from the Service
- Impersonate another person or entity
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to send spam or unsolicited communications
6. Your Content
- You retain ownership of all content you create in the Service (race data, checklists, photos, notes).
- You grant us a limited license to store, process, and display your content solely to provide the Service to you.
- You can export all your data at any time in JSON format.
- You can delete your account and all associated data at any time.
7. Weather Data
Weather forecasts are provided by Open-Meteo and are for informational purposes only. We do not guarantee the accuracy of weather data. Always check official weather sources before making race-day decisions.
8. Disclaimers
- The Service is provided "as is" and "as available" without warranties of any kind.
- Startly is a preparation tool, not medical, safety, or coaching advice. Always consult appropriate professionals for health and safety decisions.
- We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.
- We are not responsible for any decisions you make based on information from the Service (including weather data, pace calculations, or checklist items).
9. Limitation of Liability
To the maximum extent permitted by law, Startly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $25, whichever is greater).
10. Account Termination
- You may delete your account at any time from within the app.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your data will be permanently deleted within 30 days.
- Active Pro subscriptions should be cancelled through your App Store or Google Play account to avoid further charges.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state where Startly is headquartered.
